Foreigners can legally own a condo 100% registered in their name.
A house (the building) can be owned 100% in the foreigners name. The land cannot be titled in the foreign name and can only be secured by way of a 30 year lease registered at the land office or the formation of a Thai company. If the foreigner is married to a Thai national then the land could be placed in their name and the home in the foreign name.

If you plan to build a new home then first find a reputable builder and make sure to have the building permit registered in your name. Then you will be the owner of the building and the house book will be listed in your name. In case of the land you will still need to lease that or form a legal Thai company to control the land. A good lawyer will help you through the process.

Questions about Selling a Property

There are several options to selling a property. You can list with an real estate agent that will help advertise and sell your property. They charge a typical commission of 5% of the sale and help you through the entire process including transfer at the land office. Fee is only charged on successful sale by the agent. The other option is to list it yourself on real estate websites such as Thailand Luxury Homes or Thailand Real Estate Company and pay a small fee for advertising.

The actual transfer process can be completed in 1 day at the land office after all the contracts are signed and buyer and seller in agreement. The agent or lawyer will help you will any paperwork and the complete transfer of the title at the land office.
